CERCLA Periodic (“Five-Year”)

All remedial actions conducted under the
Comprehensive Environmental Response, Compensation and Liability
Act (CERCLA) that result in any hazardous substances remaining
at the site or where the affected land has some restriction on
its use due to contamination, either temporarily or permanently
are required to undergo periodic evaluations to ensure
protection of human health and the environment. These reviews
must be done no less frequently than every five years. The
Corps of Engineers has provided support over a number of years
to the US Environmental Protection Agency and the Department of
Defense in conducting five-year reviews.

resources for performing these reviews.
The process of conducting a five-year
review may be preceded by a Remediation System Evaluation. The
results of the RSE system effectiveness evaluation would support
the purpose of the five-year review. Alternatively, the RSE
process may form the practical basis for conducting the
five-year review, and the results of the RSE would be presented
in the appropriate five-year review report format.
